Scope of Functions and Responsibilities :

Under the supervision of the Director of Equity & Compliance, the DHR/Title IX Investigator is responsible for receiving and processing complaints, issues, and concerns involving allegations of discrimination, harassment, and retaliation (DHR) on the basis of protected status. The DHR/Title IX Investigator conducts timely investigations, including intakes; interviewing complainants, respondents, and relevant witnesses; reviewing documents; conducting research; and analyzing evidence to make reasoned determinations as to whether allegations are substantiated in violation of California State University (CSU) and/ or university policies. The Investigator prepares detailed investigative reports that summarize the investigative process and clearly articulate findings and outcomes, pursuant to requirements set forth in CSU Executive Orders and/or the CSU Nondiscrimination Policy. When appropriate, the Investigator also facilitates the informal resolution of complaints.

The individual in this role must possess excellent critical thinking skills, including the ability to analyze information, evaluate results, and facilitate the resolution of difficult challenges while maintaining strict confidentiality and sensitivity. They must be able to work collaboratively and professionally across multiple constituencies to resolve complaints in a neutral and sensitive manner. Strong interpersonal skills are essential, including the demonstrated ability to listen well and show sensitivity and respect for individual needs.

The Investigator must also demonstrate skill and sensitivity interacting with individuals from various ethnic, social, cultural, economic, and educational backgrounds, and must be firmly committed to principles of due process, fairness, and respect.

Preferred: Demonstrated knowledge of nondiscrimination laws, trauma-informed investigations, and compliance regulations (including Title IX, Title VI, Title VII, related state laws such as FEHA, the Clery Act, VAWA, and FERPA), as well as due process protections as they apply to Student Conduct policies.

Duties

Investigation Process & Case Management
  • Investigate claims of discrimination, harassment, sexual misconduct, dating/domestic violence, stalking, and retaliation in a fair, impartial, and timely manner.
  • Identify and interview relevant parties and witnesses; gather directly related evidence.
  • Document all investigatory meetings.
  • Document investigation steps in the case management system.
  • Prepare detailed investigation reports, including credibility assessments and findings of fact.
  • Other duties as assigned to support the work of the Office of Equity and Compliance.

Communication & Correspondence
  • Compose and send appropriate correspondence with parties, advisors, and others related to investigations and resolution processes.
  • Prepare periodic investigation updates for the Director of OEC and other need-to-know stakeholders.

Hearings & Resolution
  • Appear at hearings conducted under the CSU Nondiscrimination Policy to provide information on investigations.
  • Facilitate informal resolution of complaints, when appropriate.

Compliance, Policy, & Professional Development
  • Stay current on federal and state laws, litigation trends, and CSU executive orders and policies.

Qualifications:

Educational Background & Subject Matter Knowledge
  • REQUIRED:
    • Bachelor's Degree with at least 1-2 years of relevant experience in higher education, law, compliance, or related field.
  • PREFERRED:
    • Master's degree in a related field or a Juris Doctorate (JD).
    • Knowledge of Title IX, Title VI, Title VII, and related state laws, such as FEHA.
    • Working knowledge of applicable state and federal employment laws, as well as CSU policies pertaining to workplace complaints and/or investigations.
    • An understanding of the higher education environment and a unionized environment.

  • REQUIRED:
  • Excellent interviewing and investigatory skills, and knowledge of investigatory methods and procedures.
  • Strong critical thinking, analytical, research, and problem-solving skills.
  • Ability to manage an ongoing and complex caseload of investigations, prioritize work, and meet deadlines.
  • Strong case management skills.
  • Ability to use appropriate judgments when making decisions and recommendations.
  • Lead diverse teams to support the operational mission and vision of employers by fostering an ethical, inclusive and collegial work environment.
  • Demonstrated ability to support ongoing improvement through courageous, resilient, and catalytic leadership.
  • Lead varying initiatives through a collaborative, service-oriented and communicative approach.

Pay, Benefits, & Work Schedule
  • Salary is commensurate with knowledge, skills, and experience. The University offers excellent fringe benefits.
  • The anticipated HIRING RANGE: $105,000 - $115,000 per year, dependent upon qualifications and experience.
  • The position is currently hybrid (3 days in office, 2 days remote); however, this is subject to change based on student and/or operational needs.
